立院三讀 外勞年限延為12年

立法院臨時會今天三讀修正通過就業服務法部分條文,放寬藍領外勞在台工作期限,從原定9年延為12年;

不過,有立法委員說,這將嚴重衝擊本國勞工權益及長期照護政策。

根據修正條文,將產業外籍勞工、家庭幫傭、社福外勞及遠洋外籍漁工等外勞在台期限,全部從9年延

長為12年。

中華民國紅十字會總會長陳長文前年底以「極重度殘障兒子的爸爸」身分,向國會請命,希望修法,讓

服務已快滿9年的外籍看護,能延長停留時間到12年。

立法院下午處理這項議案時,中國國民黨立法院黨團提出修正動議,不僅讓社福外勞工作期限從現行9年

延長為12年,還擴及產業外勞、家庭幫傭和遠洋外籍漁工,未來產業外勞、家庭幫傭與遠洋外籍漁工,

可延長工作期限到12年。

民主進步黨籍立委黃淑英接受訪問時表示,這明顯是總統馬英九選後回饋企業,將衝擊本國勞工權益;國

民黨籍立委江義雄也說,不應放寬產業外勞、家庭幫傭等外勞在台工作期限。

此外,根據修正條文規定,僱用外勞的雇主須繳納就業安定費,未依規定期限繳納者,得寬限30日;寬限期

滿仍未繳納者,每日加徵就業安定費0.3%滯納金,但以未繳的就業安定費的30%為限。

The China Post news staff--The Legislative Yuan ratified, in an extra session held yesterday, draft revisions to the Employment Services Act, boosting the maximum duration of stay in Taiwan by foreign blue-collar workers to 12 years from the existing 9 years.

Based on the revisions, foreign workers employed to serve in manufacturing and construction industries, serve as domestic helpers, handle social welfare jobs, or take offshore fishing jobs will be allowed to stay in Taiwan for a maximum of 12 years.

The Legislature ratified the relaxation measure in response to a call from C.V. Chen, president of the Red Cross Society of the Republic of China, who asked the Legislature to extend the maximum stay by foreign workers in his capacity as father of a heavily handicapped son at the end of 2010.

In dealing with the bill, the legislative caucus of the ruling Kuomintang raised a motion to expand the application of the relaxation measure to almost all foreign workers in Taiwan, and finally approved the motion.

In response, lawmaker Huang Shu-ying of the opposition Democratic Progressive Party lamented that the liberalization measure is mainly designed to reward local enterprises for their support for the re-election bid of President Ma Ying-jeou.

Huang said that the measure will certainly undermine the interests of domestic workers. Even lawmaker Chiang Yi-hsiung of the KMT also noted that the maximum duration of stay for foreign workers in industrial sectors and households should not be extended from the existing nine years.

The Legislative Yuan yesterday also passed draft revisions to the Farmers Association Act, the Fishermen Association Act, and the statute governing the organization of farmland irrigation associations.

The Legislature is expected to complete its third reading of the statute governing the re-organization of the Executive Yuan or the Cabinet to legalize the reorganization of the administrative body.

The new law-making body will the formed on Feb. 1, when newly elected 113 lawmakers will be sworn in for a four-year term.
